On October 17th<\/sup>, 2023, the Department of Labour, War Invalids and Social Affairs issued Decision No.1560\/QD-LDTBXH amending and supplementing administrative procedures in Decree No. 70\/2023\/ND-CP that amends Decree No. 152\/2020\/ND-CP on the employment of foreign employees in Vietnam and the recruitment and management of Vietnamese employees working for foreign organizations and individuals in Vietnam (“Decision No. 1560<\/strong>“).<\/p>\n

As such, Decision No. 1560 has amended, supplemented the following 11 administrative procedures on using foreign employees, including:<\/p>\n

    \n
  1. Central-level administrative procedures<\/strong><\/li>\n<\/ol>\n

    Administrative procedures in the field of foreign employees working in Vietnam under the management of the Ministry of Labor, Invalids and Social Affairs that are amended and supplemented includes:<\/p>\n

    (i) Explanation on the demand for, and changes in, the use of foreign labor.<\/p>\n

    In which should be noted that the new process for this procedure shall become applicable starting from January 1st<\/sup>, 2024.<\/p>\n

    (ii) Granting of work permits to foreign employees working in Vietnam.<\/p>\n

    (iii) Reissuance of work permits to foreign employees working in Vietnam.<\/p>\n

    (iv) Extension of work permits to foreign employees working in Vietnam.<\/p>\n

    (v) Confirmation on work permit exemption of foreign employees.<\/p>\n

      \n
    1. Provincial-level administrative procedures<\/strong><\/li>\n<\/ol>\n

      (i) Explanation on the demand for, and changes in, the use of foreign labor.<\/p>\n

      (ii) Request for the recruitment of Vietnamese employees for positions intended to be filled by foreign employees of contractors.<\/p>\n

      (iii) Granting of work permits to foreign employees working in Vietnam.<\/p>\n

      (iv) Reissuance of work permits to foreign employees working in Vietnam.<\/p>\n

      (v) Extension of work permits to foreign employees working in Vietnam.<\/p>\n

      (vi) Confirmation on work permit exemption of foreign employees.<\/p>\n

      Decision No. 1560 is effective starting from October 17th<\/sup>, 2023.<\/p>\n
